Unlike some states, Oklahoma recognized common law marriage and allows a couple to obtain one, as long as the criteria listed below is met. It should be noted that, contrary to popular belief, no residency requirements are in place. Under Oklahoma state law, a couple must provide evidence within the following five categories in order to be considered man and wife:
- Both individuals agree to live as husband and wife
- The relationship between the two individuals is permanent
- The couple is exclusive to one another
- The couple has cohabitated
